As a student of Shockwave Defense™ I agree to participate in my training to the fullest of my ability. I understand that my success is based on my practice and commitment to showing up online or in person and isn't any one else's responsibility except my own. I won’t assume if I don’t know how something work, I will ask.

I will handle myself with integrity, be teachable, decisive, and resourceful. I will follow through with what I say in training and otherwise. I further agree to use the knowledge I gain to protect my loved one's, myself, and help my community. I understand that failure to do so, or the misuse of this training in any way will lead to immediate dismissal from this and all future training’s without refund.

1. Attendance & Scheduling: It is the sole responsibility of Student to ensure timely arrival, participation and attendance at all classes that are scheduled for Student. Shockwave Defense™ (SDU) may make modifications to class schedules, times, sizes, names and pricing at its sole discretion and the instructor(s) and instructor qualifications may vary. Failure to arrive timely, participate or attend any scheduled class does not constitute a waiver to the Payment Schedule. SDU may close the school on national holidays and/or for special events that may be unknown to Student. Student will check online resources made available to the student regularly see if class modification are being made. The Payment Schedule shall not be modified by these closings. Make up days may be requested in writing and SDU will do its best to accommodate students.

2. Marketing: If present in a training student consents to Shockwave using Student's name and likeness for promotional, marketing and educational materials. Student will receive no compensation for such use of name and likeness. If student wishes to not be in marketing materials student may request in writing each time cameras are present to not be used. Accomodations may be made to remove student from class or other arrangements can be made.

3. Messaging: Shockwave Defense™ LLC, Mobile Account Management services require no purchase or fee for participation unless otherwise stated. Carrier message and data rates may apply to each message sent through automated dialing equipment and/or received from the participant. Confirmation and Opt Out. You understand and agree that you will receive a confirmation text message. Such confirmations may offer you the opportunity to opt-out. You may opt out of receiving Shockwave Defense™ LLC Mobile Account Management Text Messages by following the opt-out instructions. If you experience any problems with opting out of Shockwave Defense™ LLC Mobile Account Management Text Messaging or if you need help or additional information related to Shockwave Defense™ LLC Mobile Account Management Text Messages, please call the office. If you opt out of Shockwave Defense™ LLC Mobile Account Management Text Messaging, you are only opting out of receiving mobile alerts. This may cause you to miss important notices and other information. Do so at your own discretion.

4. Teaching Outside of Shockwave: Student agrees to not engage in self-defense teaching practices within the United States for a period of 5 years following disassociation with Shockwave Defense™, without prior written permission of Shockwave Defense™ unless stated otherwise herein.

5. Payment: Payment(s) does not guarantee belt/rank certification or any likeness. All recognitions at Shockwave Defense™™ must be earned at/through Shockwave and does not include travel or other expenses student may incur ancillary to the training received.

6. Student agrees to make timely payment in order to avoid a $35 late fee and a 1.5% daily fee until payment is made.

7. Right to Refuse Service: Shockwave Defense™ reserves the right to refuse service to anyone on its sole discretion.

8. Personal Weapons: If training in live events, students shall not bring any weapons of any nature to class or to lessons unless specifically authorized to do so in writing from Shockwave Defense™.

9. Physical Condition: Student represents that (s)he is in good physical condition, is not suffering from any heart, lung or other bodily aliment and is in all respects physically fit to engage in the self-defense course. Student also admits that (s)he has no communicable diseases that can be transferred to other students and/or instructors.

10. Student acknowledges that the training and lessons student receives will involve the use of physical force and physical contact and may or could result in injury and/or death. Student may be provided with protective gear, or may bring their own. Shockwave Defense™ does not warranty that the protective gear will prevent injury or death and Student hereby releases and discharges Shockwave Defense™, its members, employees, agents and assigns from any and all liability arising from the services Student receives from Shockwave Defense™ onsite or offsite while training, or interacting.

11. Payment Default, Cancelation & Fees: If a student defaults on an agreement Shockwave Defense™ may retain expenses incurred.

12. No-Refund Policy: Our training is world class and majority of the concepts, strategies, and tactics are proprietary. Through decades and painstaking research, these concepts have been simplified to be effective. Once the knowledge base has been given to you, and you have access to it cannot be retrieved; Therefore, you agree not to engage in “Friendly Fraud” and understand that we offer a no-refund policy unless otherwise stated herein. Down payments, non-schedule/no-show, failure to show or attend are non-refundable, as well as Paid In Full’s (PIFs). Monies paid on day of signing are non-refundable unless otherwise stated herein. If other arrangements have been placed in writing and agreed upon by both parties they shall remain in full force and effect unless otherwise stated herein. Please do not attempt to fraud or gain knowledge without payment. We appreciate your integrity in advance.

13. Cancelation of any ongoing memberships (if available) requires the completion of an authorized Shockwave Defense™ cancellation form and an in person meeting which can be obtained from a school administrator. The membership cancellation is cancelled when all payments due within the specified notification period are paid in full. If a notification period is not specified, a minimum of 90 days notice is implied. If there is a term specified, a 90 day cancelation will be added to the end of the original agreement if one is not given 90 days prior to the agreement termination. Student may retains membership rights & privileges until the notification period expires unless excused for bad or dangerous behavior.

14. “TERM” agreements are non-cancelable unless stated herein. School administrators may raise the tuition rate of ongoing memberships providing advance notice equal to the cancellation notice stated herein. Because Shockwave Defense™ offers multiple training options multiple agreements may simultaneously exist. Read these agreements carefully to ensure your understanding.

15. Though we never anticipate a student failing to fulfill their agreement it can happen. If a student become delinquent on any agreements student is liable for all reasonable costs of collections, including but not limited to court costs and attorney fees. Shockwave Defense™ reserves the right to cancel this agreement at any time should student be delinquent on payments called for under the Payment Schedule. Shockwave Defense™ is authorized to bill and collect student tuition and may use an outside billing company for such purposes. Shockwave Defense™ may refer an account to a collection agency or attorney’s office for debt collection and/or credit reporting.

16. Arbitration: Any claim, controversy or dispute that arises under or relates to any service or this agreement, shall be resolved by binding arbitration in accordance with the New Mexico’s Arbitration Act. The Arbitration shall occur in Bernalillo County, State of New Mexico. The Arbitrator shall apply New Mexico State law. The arbitrator shall be chosen by agreement of the parties, or, if no agreement can be reached, each party shall designate an arbitrator and the two arbitrators shall choose a third arbitrator to serve in this matter. The prevailing party shall be entitled to an award of attorney fees and costs associated with the arbitration.

17. It should be noted that any financing arrangements may carry with them additional terms and conditions from those agencies/companies interest and additional fees for financing may apply.

18. For live or ongoing trainings: Changes and Modifications can occur in schedule: Student understands that due to changes in laws, regulations, insurance obligations and training techniques, that the terms herein may require modification or amendment. Student agrees that Shockwave can submit changes, additions, modifications to the terms herein. Student shall receive a copy of the changed terms. It is understood that student may not be requested to sign a new agreement with the changes, modifications or amendments but they may be enacted.

19. Copyright: Nothing herein grants student a license or permission to use the name, likeness, trademark or any other intellectual property owned by Shockwave Defense™ in any manner without the express written approval of Shockwave Defense™. Student shall not use the Shockwave Defense™ Logo or Trademark on any materials without Shockwave Defense™’s prior written approval of the materials’ use.

*By purchasing this product, I agree to act responsibly with the techniques that I learn. Under no circumstance shall the information learned be used unless required for self-defense purposes. I pledge to act with integrity with the knowledge I ascertain and only to use it under extreme life and death conditions.

*I understand the training I’m receiving is world class and proprietary, once I have started the knowledge base is there, and therefore understand that Shockwave Defense™ will not offer refunds unless otherwise stated herein.

*I have read all the additional training agreement terms & conditions to this agreement and acknowledge full responsibility to the terms and conditions stated herein as required for membership.
